An attorney claims that Donald Trump's "repeated lies" during his deposition may have seriously hurt his case in the defamation lawsuit launched against him by a woman who accused him of rape.

The leaked transcripts of Trump's testimony in the lawsuit filed by former Elle columnist E. Jean Carroll prompted a response from legal commentator and MSNBC anchor Katie Phang.

Carroll said that in the middle of the 1990s, the former president raped her in a Bergdorf Goodman dressing room in New York. The claim is refuted by Trump.

Trump, who denies the accusations and said in a 2019 interview that Carroll was "not my type," is being sued by Carroll for defaming her reputation. Later, soon before giving his deposition in October 2022, Trump made the same points again in a statement published on Truth Social.

Trump defended his "not my type" comments during his testimony, which was released on Monday. He also called Carroll's allegations of rape a "hoax" and his accuser a "whack job" and a "lie," in addition to claiming that Carroll was lying about the rape.

In addition, Trump claimed that numerous inquiries and investigations of him, including the first impeachment trial of the previous president and Robert Mueller's Russia inquiry, were "hoaxes." Trump continued to make up stories about voter fraud and called mail-in ballots a hoax even though he admits to using them to cast his vote.

Nicolle Wallace of MSNBC questioned Phang on Monday's episode of Deadline: White House about the legal relevance of Trump making these statements while under oath, in addition to the fact that it made him "sound like a jack***."

"The legal significance is he steps in it and over and over again," Phang said. "And more importantly, later on in his deposition, he basically denies flat out that he's ever touched a woman and any part of her body—specifically denying touching a woman on her breast or buttocks or any other sexual part without her consent.

He denied it while sworn in. Everyone knows that he boasted about how he would grab them by the "blank" on an Access Hollywood tape, and you could do it when you're a star, Phang continued. Throughout this sworn videotaped deposition, he has been exposed for telling numerous lies.

When Carroll's defamation case goes to trial in April, Phang said that Trump's evidence given under oath will unquestionably be used against him because "the more that you are depicted as a liar, the more that you are a liar and a jury is going to judge that."

In other places, Phang claimed that Trump did not assist himself by being "dumb" enough to continually interject during his deposition in addition to repeating his "not my type" remark about Carroll on Truth Social in October.

"He's gonna go to trial in April and he is more likely than not going to be found liable for the claims that are brought by [Carroll], and that is why this videotaped deposition is so important," Phang added.
